Section,4. (1) (b) (i) The particulars of its organization, functions and duties:

This Directorate was constituted in 1939, as part of the Board office for conducting periodical inspections and for advising the Board on technical questions and on standarisation of Organisation and procedure in the Custom Houses and the Central Excise Collectorates. It was separated from the Board on 1st April, 1946 and given the status of an Attached office.

This Directorate does not exercise any statutory powers under the Customs Act or the Central Excise Act, as it is not recognized as an authority for the purposes of those Acts. It mainly comprises of five Regional Units (North Regional Unit/Central Regional Unit/West Regional Unit/South Regional Unit/East Regional Unit), Customs Wing (Hqrs.), Central Excise wing (Hqrs.), Administrative Wing & Nepal/Bhutan Refund Wing, Under the immediate supervisory control of the Director General, and performs following functions, as approved by Central Board of Excise and Customs, Department of Revenue, Ministry of Finance.

To study the working of the Customs, Central Excise and Narcotics Departmental machinery throughout the country.

To suggest measures for improvement of its efficiency and rectification of important defects in it through inspection and by laying down procedures for smooth functioning.

To carry out inspection to determine whether the working of the field formations are as per Customs and Central Excise Procedures, and to make recommendations in respect to the Procedural flaws, if any noticed.

To suggest measures for improvement in functioning of the field formations.

To function as nodal agency of Central Board of Exicse and Customs for implementing various works relating to Hindi (Rajbhasha) in the field formations and to coordinate with Grah Mantralya (Rajbhasha Vibhag)

To hold examinations for Custom House Agents under Custom House Agents Licensing Regulations, 2004.

To attend to the work pertaining to Nepal and Bhutan Rebate Claims
Preparation of manuals under the Customs and Central Excise Law and Procedure

To conduct special studies as entrusted by CBEC.

(ii)       Powers & duties of the officers and employees:

No specific powers have been given to the offices under the Directorate General.

Director General (Inspection) is the Head of the Department having all India jurisdiction. He is supervising and contorolling the functions of all the Regional Units located at Mumbai, Chennai, Kolkata, Delhi and Hyderabad. Each Regional Unit is headed by one Addl. Director General who is the Head of the Department. At the Headquaters office, the ADG (Hqrs. and Admn.) has been delegated the powers of Head of the Department. Director General (Inspection) is the Cadre Controlling authority of Group B,C and D Staff for the Directorate General of Inspection, DG(Vigilance), DG(Housing and Welfare), DG(Export Promotion), office of the CDR, Directorate of legal Affairs, DG(Audit), DG(Safeguards) and Directorate of Organization and Personal Management.

All ADGs are assisted by Addl. Directors / Jt. Direcotors / Dy. Directors and Asstt. Directors.

The inspection teams are responsible to carry out inspections as per the check list

The inspection notes are drawn and sent to the concerned Commissionerates for compliance.

With regard to administrative matters, proposals/actions to be taken are processed at the Section level and put up to Jt. Director (admn.) and finally approved by ADG(Admn.) under overall supervision and control of Director General.

(iv)      The norms set by it for the discharge of its functions:

Inspections are carried out as per the inspection programme in respect of each commissionerate

For implementation of  Official Language Policy, an inspection programme is also drawn for conducting of inspections and the same is circulated to all the Zones/Commissionerates under CBEC. Annual programme for implementation of  Official Language Policy has also been circulated to the Commissionerates/Directorates for achieving the targets as fixed by Department of Official Language, Grah Mantralaya for the year 2005-06.

Administrative matters are attended to as per the rules and regulations.

Section,4 (1) (b) (i) The particulars of the organization, functions and duties

Directorate of Publicity and Public Relations was established in the year 1979 as an attached office to Central Board of Excise and Customs, Deptt. of Revenue, Ministry of Finance. The Hqrs. Office of the Directorate is situated at Central Revenue Building, I.P. Estate, New Delhi. The Commissioner is the head of the Directorate. Besides Commissioner, there are two Addl./Jt. Commissioners and three Asstt. Commissioners along with subordinate staff. This Directorate has got no Zonal/Branch Office.

This Directorate is primarily responsible firstly for publicity campaigns concerning public awareness of Service Tax, Central Excise and Customs and for this purpose all the available media including print media, electronic media and Internet are used. The second important assignment of this Directorate is to maintain public relations.

The Commissioner of this Directorate is also a nodal Officer for implementation of Citizen’s Charter and Public Grievances.

(ii)       The powers and duties of officers and employees

The Officers working in this Directorate are discharging their duties as entrusted by CBEC. Besides the functions mention at S.No. (1) above, this Directorate is also responsible for publication, inter-alia, of Central Excise Tariff and Custom Tariff.

commissioner, is the Head of the Department and overall in-charge of this Directorate having all administrative and financial Powers. Jt. Commissioner, Administration assists the Commissioner and supervises work of staff posted in this Directorate.

Group ‘b’and ‘c’ staff carry out the work pertaining to their respective sections as well as any work assigned to them by their superiors from time to time.

(iii)      The procedure followed in the decision-making process including channels of supervision and accountability

Among the officers posted in the Directorate, Commissioner represents as the Head of the Directorate and takes final decisions on all important issues. Two Addl./Jt. Commissioners and three Asstt. Commissioners assist the Commissioner in carrying out the entire work of the Directorate and supervise the work and performance of the subordinate staff.

(iv)      The norms set for the discharge of its functions.

No norms have been prescribed for functioning of this Directorate. However, publication of Central Excise  and Custom Tariffs, and other periodicals are carried out by this Directorate. Further, this Directorate also publishes Notifications & Circulars issued by CBEC on day to day basis as well as disseminating the  Notifications & Circulars on the same very day as statutorily required. The Directorate is also discharging functions as desired by Board.

Section,4 (1) (b) (i) The particulars of its organization, functions and duties:

(i) The charter of functions and duties assigned to this Directorate General are as under : 

1.

To interact with Export Promotion Councils for various categories of export to sort out the difficulty being faced by the genuine exporters.

2.

To function in close liaison with allied agencies concerned with the Exports to ensure that genuine exporters get the full advantages of the export schemes without any difficulties.

3.

To monitor the performance of the field formations through the monthly quarterly returns, like duty- foregone statements, drawback payment statements and quarterly drawback payment statements and to do comparison and compilation of the same to enable the Ministry to review the policy.

4.

 To carry out the appraisal studies to examine the efficacy of the existing legal provisions/ rules and procedures and suggest to the Ministry, changes to be made, if any.

5.

 All work relating to DAPs, ATNs and reports of C & AG and PAC; follow up action with C & AG , on Customs matters, excluding drawback.

6.

Following Export Promotion Schemes and work related thereto (both Customs and Central Excise).

 

(i)                  100 % Export Oriented Units.

(ii)                 Free Trade Zones, Export Processing Zones and Special Economic Zones.

(iii)               Special Jewellery Complexes and Gem and Jewellery Export Promotion   Schemes.

Meeting of FIPB, BOAs, Inter-Ministerial Standing Committee, etc, meetings with DGFT/ Ministry of Commerce on matters relating to above Export Promotion Schemes and interaction with Trade, Export Promotion Councils.

Act as a central consultative body with the trade and other stakeholders (Trade Associations and Chambers of Commerce such as FIEO, Federation of Freight Forwarders Associations of India, Air Cargo Agents Association of India, national Association of Container Freight Stations, Export Promotion Councils, Indian Ports Association, etc.) and suggest changes in Customs clearance procedures with a view to facilitate international trade, wherever necessary.

Review Customs trade facilitation measures from time to time with a view to evaluate their efficacy and suggest further improvements

Over-see and analyze the dwell time for clearance of import / export cargo at various major ports, airports, ICDs, etc. and, as appropriate, make recommendations relating to clearance procedures followed by Customs and other agencies, with a view to reduce dwell time.

Review the trade facilitation initiatives of the Custom Houses and other field formation e.g.

- Review the working of the Drawback Committees/ Regional Advisory   Committees/ Watch Dog Committees, etc. in the various customs field formations for any modification in law and procedures

- Monitor the maintenance and updating of the websites of the Customs Commissionerates / Customs Houses.

Work relating to WTO Negotiations on Trade facilitation; matters relating to Trade Facilitation under various Trade Agreements.

15.

 Matters related to recommendations of WCO on trade facilitation.

(ii)       The powers and duties of its officers and employees:

No specific power under any Act has been given to the officers under this Directorate General. With respect to the duties, the variuos functions as enumerated above are to be carried out by seeking various information, data, reports from the field formations under CBEC, industry and other available sources.

The hierarchy of the organization is as follows:

DG - ADG - Additional Director - Assistant Director - Sr. Intelligence Officer - Intelligence Officer.

With regard to Administrative matters proposals/action to be taken are processed at the section level and put up to Assistant Director - Additional Director and finally approved by Additional Director General, under overall supervision and control of Director General.

With regard to functions other than Administration the issues/decisions are initially processed by I.O./SIO and put up to D.G. for approval through Assistant Director - Additioal Director - Additional Director General.

This Directorate is analyzing the duty foregone statements received from field formations and Directorate of Data Management and submitting comprehensive report to the Board. The norms set are that the analysis and the data should be accurate and brief.

This Directorate General is also entrusted with the function of attending to grievances of genuine exporters. The officers should be prompt in attending the genuine grievances.

The norms set at various levels are to collect authentic data and analyze the same correctly.

    Chemcial Laboratories of Central Revenues Control Laboratory are attached to the Customs House/Central Excise Commissionerates. These are headed by Joint Director Chemical Examiner Gr.I/Chemical Examiner Gr.II/Assistant Chemical Examiner. In common with the other sections of the Commissioners, Laboratories are under the administrative control of the Commissionerates except the Central Revenues Control Laboratory, New Delhi which is under the administrative control of Director (Revenue  laboratory). (ii)       Powers and duties of officers and employees posted at Central Revenues Control Laboratory, New Delhi.

Director (Revenue Laboratories): Director (Revenue Laboratories) is the technical and administrative head of the organisation. He is cadre controlling authority of the Group ‘‘B” ‘‘C’’ & ‘‘D’’ Officers. Director (Revenue Laboratories) is also appealate authority in respect of disputes if any arisen in testing matters

Joint Director: To assist the Director (Revenue Laboratories) in respect of technical & Administrative matters

Chemical Examiner Gr.I: To assist the Joint Director and Director (Revenue Laboratories) in day to day technical administrative works. Issue the test report under his signature

Chemical Examiner Gr. II: To assist Director, Joint Director and Chemical Examiner GrI in day to day technical and administrative matters. Issue the test report under his signature

Assistant Chemical Examiner: Assistant Chemical Examiner supervise the works of Chemical Assistants and analyse the typical samples. Assistant Chemical Examiner’s assist the Chemical Examiners in test report formation. They also provide the referencing works to the Chemical Examiners and guide the Chemical Assistant in their work.

Section,4. (1) (b) (i) The particulars of its organization, functions and duties:

The Directorate General of Safeguards under the Ministry of Finance. Department of Revenue has been created to conduct investigations for imposition of Safeguard Duty Specific Safeguard Duty as specified under Section 8B & 8C of the Customs Tariff Act, 1975 and the rules made there under the make recommendations for the same vide the findings of Directorate General to Government of India.

(ii)       Powers & duties of the officers and employees:

Director General of Safeguards is the proper officer empowered and appointed to investigate the existence of “serious injury” “market disruption”/ “threat of serious injury” “threat of market disruption to domestic industry as consequence of increased import of an article into India. To identify the article liable for Safeguard duty to submit the findings provisional or otherwise to the Central Government as to the “serious injury” “market disruption”/ “threat of serious injury” “threat of market disruption to domestic industry consequent upon increased import of an article from any country; and to recommend (a) the amount of duty which if levied would be adequate to remove the injury market disruption or threat of injury threat of market disruption to the domestic industry; (b) the duration of levy of safeguard duty which if levied would be adequate to remove the injury to the domestic industry; (c) to except such quantity of any article when imported from any country or territory into India, from payment of the whole or part of the safeguard duty leviable thereon, and to review the need for continuance of safeguard duty.

(iii)      The procedure followed in the decision making process, including channels of supervision and accountability

The procedure to be followed regarding safeguard matters have been provided under Rule 4 to 7 of the Customs Tariff (identification and assessment of Safeguard Duty) Rules, 1997 and Customs Tariff (Transitional Products Specific Safeguard Duty) Rules 2002, according to which Director General of Safeguards can initiate safeguard investigation on an application filed by the domestic industries or on the suo-motto information of the Comissioner of Customs, give notice of initiation to all interested parties to file their response, hold public hearing and formulate his findings and recommend the imposition of Safeguard duty or not to Government of India. Safeguard Duty Rules and China Specific Rules have been framed under Section 8B & 8C of the Customs Tariff Act, 1975.

(iv)      The norms set by it for the discharge of its functions:

Findings and the recommendations of Director General of Safeguards are to be made within 240 days of mitiation by the Directorate General of Safeguards.

(v)        Rules, regulations, instructions, manuals & records held by it or under its control for being used by the employees for discharging its functions:

Safeguard Rules have been framed under Section 8B and 8C of the Customs Tariff Act, called as Customs Tariff (Identification and Assessment of Safeguard Duty) Rules, 1997 and Customs Tariff (Transitional Products Specific Safeguard Duty) Rules, 2002.

(1) Application of domestic industry, (2) Notice of initiation and responses received from various interested parties in the said context (3) Notice of Public hearing and written submission made during or subsequent to public hearing. However its non-confidential version is made available to all interested parties. (5) A public file mandatorly maintained by Director General’s office containing all documents pertaining to an investigation except confidential proprietary information is accessible to all interested parties. The Notice of initiation and findings/recommendations of the Director General are duly published and notified in Government of India Gazette, which are available to the public. Additionally all the details of such documents etc. are also made available on the web site of the Directorate General of Safeguards.

A public hearing is mandatorily held in all safeguard investigations.

Secreatry (Commerce) (Revenue) (Industrial Policy and Promotions)/(Agriculture and Co-operation)/(ER). Ministry of External Affairs and Secretary of the Concerned Department dealing with the product for which Sareguard Duty protection has been sought to consider the recommendations of Director General of Safeguard. The proceedings of the Standing Board of Safeguard are not open to the public.

Directorate of Organisation & Personnel Management is headed by Commissioner. Its office is located in the 4th floor, Deepshikha Building, Rajendra Place, New Delhi. Functions of dopm include looking after the functions relating to method studies, work measurement and staffing besides management services including manpower planning for the Customs, Central Excise, Service Tax & narcotics formations.

(ii)       Powers & duties of its officers and employees

dopm acts as an advisor to cbEC in areas of human resources management.

(iii)      Procedure followed in decision-making process, including channels of supervision and accountability

dopm is only an advisory body that advises the Board on the matters related to human resources management in the Department. As such, work profile of this does not require any major decision-making. Whatever small decision-making is done in this Directorate, it is, basically restricted only to day-to-day functioning of the Directorate. In such matters, decisions are mostly taken at the level of Dy./Assistant Commissioner (Administration). Some decisions having greater importance are, however, taken at the level of Additional/Joint Commissioner (Administration) also. The matters related to human resources management of the Department referred by the Ministry to this Directorate for advice or comments are put up to Commissioner, who finalizes such advice/comments.

The Directorate of Housing & Welfare was set up vide Ministry’s F. No. A-11019/34/2002-AD IV dated 27-06-2002 with its headquarter at Delhi under the supervisory control of a Commissioner. This Directorate is functioning as a liaison agency on all housing and welfare matters of cbec and its field formations. It is pertinent to mention that no public dealing is handled by this Directorate.

Functions & duties of the Directorate:
 

To monitor and co-ordinate with the Central Board of Excise & Customs/Ministry and field formations regarding housing projects

To help and assist field formations in framing the project proposals and in implementation of approved projects

To co-ordinate with the field formations with regard to problems of encorachment and abandoned properties
To devise procedures for accounting and documentation system
To keep the field formations informed about the various schemes and facilities available
To co-ordinate with the Ministry on welfare measures related to officers and staff under cbec

(ii)       Powers & duties of the officers and employees:

All cases pertaining to purchase of land and ready built flats and for granting administrative approval and expenditure sanction for the same are handled by the Directorate.

All cases of purchase of ready built office and residential accommodation from private as well as Government agencies are being handled by Directorate of Housing. After examination and scrutiny of the proposals, the same will be forwarded to the Ministry for obtaining the approval of Finance Wing.

Cases relating to construction of office building involving expenditure more than Rs two crores and of residential accommodation through CPWD are handled by the Directorate

An inventory of accommodation, office and residential, available with the department at all levels is being prepared

Detailed policy papers on setting up of various welfare measures for the Departmental officers

Examination of proposals regarding hiring of office/office-cum-residence accommodation and godown accommodation in respect of the attached and subordinate offices

Examination of proposals regarding construction/purchase/hiring of guest houses, transit accommodation

(iii)      The procedure followed in the decision making process, including channels of supervision and accountability
 

All Housing Projects received from field formations of CBEC are being examined as per existing instructions/guidelines and after scrutiny the same are being forwarded to the Ministry for administrative approval and expenditure sanction

All matters relating to infrastructure including purchase of land and ready built buildings/flats are routed through this Directorate to the Ministry.

The Directorate is functioning as a liaison between the Ministry and field formations of CBEC

(iv)      The norms set by it for the discharge of its functions:

            All proposals regarding housing projects, hiring of office accommodation, construction of departmental buildings are scrutinized and after detailed examination of all the requisite information, the same are forwarded to the Ministry for administrative approval.

(v)        Rules, regulations, instructions, manuals & records held by it or under its control for being used by the employees for discharging its functions:

            The proposals for construction of office and residential complex are processed on Merit and the construction work is through CPWD.
