Section,4. (1) (b) (i) The particulars of its organization, functions and duties:

This Directorate was constituted in 1939, as part of the Board office for conducting periodical inspections and for advising the Board on technical questions and on standarisation of Organisation and procedure in the Custom Houses and the Central Excise Collectorates. It was separated from the Board on 1st April, 1946 and given the status of an Attached office.

This Directorate does not exercise any statutory powers under the Customs Act or the Central Excise Act, as it is not recognized as an authority for the purposes of those Acts. It mainly comprises of five Regional Units (North Regional Unit/Central Regional Unit/West Regional Unit/South Regional Unit/East Regional Unit), Customs Wing (Hqrs.), Central Excise wing (Hqrs.), Administrative Wing & Nepal/Bhutan Refund Wing, Under the immediate supervisory control of the Director General, and performs following functions, as approved by Central Board of Excise and Customs, Department of Revenue, Ministry of Finance.

(ii)       Powers & duties of the officers and employees:

No specific powers have been given to the offices under the Directorate General.

Director General (Inspection) is the Head of the Department having all India jurisdiction. He is supervising and contorolling the functions of all the Regional Units located at Mumbai, Chennai, Kolkata, Delhi and Hyderabad. Each Regional Unit is headed by one Addl. Director General who is the Head of the Department. At the Headquaters office, the ADG (Hqrs. and Admn.) has been delegated the powers of Head of the Department. Director General (Inspection) is the Cadre Controlling authority of Group B,C and D Staff for the Directorate General of Inspection, DG(Vigilance), DG(Housing and Welfare), DG(Export Promotion), office of the CDR, Directorate of legal Affairs, DG(Audit), DG(Safeguards) and Directorate of Organization and Personal Management.

All ADGs are assisted by Addl. Directors / Jt. Direcotors / Dy. Directors and Asstt. Directors.

Section,4 (1) (b) (i) The particulars of the organization, functions and duties

Directorate of Publicity and Public Relations was established in the year 1979 as an attached office to Central Board of Excise and Customs, Deptt. of Revenue, Ministry of Finance. The Hqrs. Office of the Directorate is situated at Central Revenue Building, I.P. Estate, New Delhi. The Commissioner is the head of the Directorate. Besides Commissioner, there are two Addl./Jt. Commissioners and three Asstt. Commissioners along with subordinate staff. This Directorate has got no Zonal/Branch Office.

This Directorate is primarily responsible firstly for publicity campaigns concerning public awareness of Service Tax, Central Excise and Customs and for this purpose all the available media including print media, electronic media and Internet are used. The second important assignment of this Directorate is to maintain public relations.

The Commissioner of this Directorate is also a nodal Officer for implementation of Citizen’s Charter and Public Grievances.

(ii)       The powers and duties of officers and employees

The Officers working in this Directorate are discharging their duties as entrusted by CBEC. Besides the functions mention at S.No. (1) above, this Directorate is also responsible for publication, inter-alia, of Central Excise Tariff and Custom Tariff.

commissioner, is the Head of the Department and overall in-charge of this Directorate having all administrative and financial Powers. Jt. Commissioner, Administration assists the Commissioner and supervises work of staff posted in this Directorate.

Group ‘b’and ‘c’ staff carry out the work pertaining to their respective sections as well as any work assigned to them by their superiors from time to time.

(iii)      The procedure followed in the decision-making process including channels of supervision and accountability

Among the officers posted in the Directorate, Commissioner represents as the Head of the Directorate and takes final decisions on all important issues. Two Addl./Jt. Commissioners and three Asstt. Commissioners assist the Commissioner in carrying out the entire work of the Directorate and supervise the work and performance of the subordinate staff.

(iv)      The norms set for the discharge of its functions.

No norms have been prescribed for functioning of this Directorate. However, publication of Central Excise  and Custom Tariffs, and other periodicals are carried out by this Directorate. Further, this Directorate also publishes Notifications & Circulars issued by CBEC on day to day basis as well as disseminating the  Notifications & Circulars on the same very day as statutorily required. The Directorate is also discharging functions as desired by Board.

(i) The charter of functions and duties assigned to this Directorate General are as under : 

I.

Work relating to the following Export Promotion Schemes (both Customs and Central Excise).

 

(i)                  100 % Export Oriented Units.

(ii)                 Special Economic Zones (including work relating to erstwhile free Trade Zones and       Export Processing Zones).

(iii)               Special Jewellery Complexes and Gem and Jewellery Export Promotion   Schemes.

(iv)                Software Technology Park and Electronic Hardware Technology Park Schemes.

II.

 Monitoring of the Export Promotion Schemes as at Item No. (1.), analysis of periodical reports/ returns / statistics, and legislative work relating to the above schemes (both Customs and Central Excise).

III.

Meeting of the Foreign Investment Promotion Board (FIPB), Boards of Approval (BOA) for EOU/ SEZ, Inter-Ministerial Standing Committee (IMSC) in the Department of Information Technology etc., meetings with DGFT/Ministry of Commerce on matters relating to above Export Promotion Schemes and interaction with Trade including Export Promotion Councils.

IV.

Act as a central consultative body with the trade and other stakeholders (Trade Associations and Chambers of Commerce such as FIEO, Federation of Freight Forwarders Associations of India, Air Cargo Agents Association of India, National Association of Container Freight Stations, Export Promotion Councils, Indian Ports Association, etc.) and suggest changes in Customs clearance procedures with a view to facilitate international trade, wherever necessary.

V.

Review Customs trade facilitation measures from time to time with a view to evaluate their efficacy and suggest further improvements

 Study the best international practices concerning Customs clearance procedures for their adoption

VII.

Over-see and analyze the dwell time for clearance of import / export cargo at various major ports, airports, ICDs, etc. and, as appropriate, make recommendations relating to clearance procedures followed by Customs and other agencies, with a view to reduce dwell time.

VIII.

Review the trade facilitation initiatives of the Custom Houses and other field formation e.g.

- Review the working of the Drawback Committees/ Regional Advisory   Committees/ EDI Committee/ Watch Dog Committees, etc. in the various customs field formations for any modification in law and procedures

- Monitor the maintenance and updating of the websites of the Customs Commissionerates / Customs Houses.

For performing the above functions, DGEP is empowered to seek and obtain information from all customs field formations. DGEP’s function would be limited to policy level issues and it would not address individual grievances relating to customs Trade facilitation (like delays in assessment of Bill of Entry, grant of refund, etc.).

Where the issue under consideration also impinges on the functioning of other wings such as the Directorate of Systems, Directorate General of Inspection, Directorate of Drawback or the relevant sections of the Board’s office, DGEP will function in consultation with these relevant Sections/ Directorates. In all such matters DGEP would function as a coordinator to address the issue(s) at hand.

ii)       The powers and duties of its officers and employees:

No specific power under any Act has been given to the officers under this Directorate General. With respect to the duties, the variuos functions as enumerated above are to be carried out by seeking various information, data, reports from the field formations under CBEC, industry and other available sources.

(iii)      The procedure followed in the decision making process:

The hierarchy of the organization is as follows:

DG - ADG - Additional Director - Assistant Director - Sr. Intelligence Officer - Intelligence Officer.

With regard to Administrative matters proposals/action to be taken are processed at the section level and put up to Assistant Director - Additional Director and finally approved by Additional Director General, under overall supervision and control of Director General.

With regard to functions other than Administration the issues/decisions are initially processed by I.O./SIO and put up to D.G. for approval through Assistant Director - Additioal Director - Additional Director General.

(iv)      The norms set by it for the discharge of its functions:

This Directorate is analyzing the duty foregone statements received from field formations and Directorate of Data Management and submitting comprehensive report to the Board. The norms set are that the analysis and the data should be accurate and brief.

This Directorate General is also entrusted with the function of attending to grievances of genuine exporters. The officers should be prompt in attending the genuine grievances.

The norms set at various levels are to collect authentic data and analyze the same correctly.

Customs Act 1962, Central Excise & Salt Act 1944 and related other allied Acts, Rules and Regulations along with Foreign Trade Policy 2002 - 2007.

    Chemcial Laboratories of Central Revenues Control Laboratory are attached to the Customs House/Central Excise Commissionerates. These are headed by Joint Director Chemical Examiner Gr.I/Chemical Examiner Gr.II/Assistant Chemical Examiner. In common with the other sections of the Commissioners, Laboratories are under the administrative control of the Commissionerates except the Central Revenues Control Laboratory, New Delhi which is under the administrative control of Director (Revenue  laboratory). Director (Revenue Laboratories): Director (Revenue Laboratories) is the technical and administrative head of the organisation. He is cadre controlling authority of the Group ‘‘B” ‘‘C’’ & ‘‘D’’ Officers. Director (Revenue Laboratories) is also appealate authority in respect of disputes if any arisen in testing matters

Joint Director: To assist the Director (Revenue Laboratories) in respect of technical & Administrative matters

Chemical Examiner Gr.I: To assist the Joint Director and Director (Revenue Laboratories) in day to day technical administrative works. Issue the test report under his signature

Assistant Chemical Examiner: Assistant Chemical Examiner supervise the works of Chemical Assistants and analyse the typical samples. Assistant Chemical Examiner’s assist the Chemical Examiners in test report formation. They also provide the referencing works to the Chemical Examiners and guide the Chemical Assistant in their work.

The procedure to be followed regarding safeguard matters have been provided under Rule 4 to 7 of the Customs Tariff (identification and assessment of Safeguard Duty) Rules, 1997 and Customs Tariff (Transitional Products Specific Safeguard Duty) Rules 2002, according to which Director General of Safeguards can initiate safeguard investigation on an application filed by the domestic industries or on the suo-motto information of the Comissioner of Customs, give notice of initiation to all interested parties to file their response, hold public hearing and formulate his findings and recommend the imposition of Safeguard duty or not to Government of India. Safeguard Duty Rules and China Specific Rules have been framed under Section 8B & 8C of the Customs Tariff Act, 1975.

The Directorate of Legal Affairs (DLA) was set up vide Ministry’s circular F. No. A-11019/31/2001-Ad.IV dated the 27th June 2002 with its headquarters at New Delhi under the supervisory control of a Commissioner rank officer. the functions of the Directorate have been enumerated in the said circular and are summarized as under:

(i)     The Directorate shall be the nodal agency to monitor the legal and judicial work of CBEC and its field formations;

(ii)    The Directorate will work in close co-ordination with CBEC, CDR’s office, Law Ministry, Directorate of Systems, Chief Commissioners, Central Agency Section of the Supreme Court of India, Senior Law officers, Government Counsels, etc.

(iii)   It will also maintain and monitor the database on the cases decided by or pending with the CEGAT, CAT, High courts and the Supreme Court;

(iv)   To intimate the field formations about important decisions of the Supreme Court and High courts which are accepted by the Department in consultations with the various nodal Ministries;

(v)     The Directorate shall recommend and maintain panels of standing Counsels/Panel Counsels for various High Courts and also keep an approved panel of eminent lawyers well versed with the customs and Central Excise Laws and other administrative matters who may be engaged by the Department for handling important cases.

(ii)       The powers and duties of officers and employees:

Powers to the officers as available under the Central Excise Act, Customs Act and Service Tax Act are available to the officers of the Directorate of Legal Affairs. With respect to the duties, the various functions as enumerated as S. No. (I) above are required to be carried out by the officers of the Directorate by keeping close co-ordination with CBEC, Law Ministry, Directorate of Systems, Chief Commissioners, Central Agency Section of the Supreme Court of India, Senior Law officers, Government Counsels in High Courts and Central Administrative Tribunal CDR’s office, CESTAT. Registry, field formations etc. The officers of the Directorate are also monitoring the cases pending in Supreme Court, High Courts, CESTAT and CAT. The Directorate of Legal Affiars is the nodal agency to monitor the legal and judicial work of CBEC and its field formations. Accordingly DLA is required to work in close co-ordination with the Legal & Judicial Sections of CBEC. The Directorate is checking the cases likely to be listed before the Supreme Court on daily and weekly basis and taking follow up action accordingly.

DLA is also maintaining and monitoring the legal and judicial database for CBEC on the cases pertaining to CESTAT, CAT; High Courts and the Supreme Court.

The Directorate has also been entrusted with the work relating to compilation of various monthly and quarterly reports relating to the cases pending in various Courts and tribunals on behalf of CBEC.

In view of the nature of work undertaken by the Directorate of Legal Affairs, the norms are fixed in such a way so as to reduce the number of cases pending before various appellate fora by proper liaisoning with the Board’s office, counsels and field formations. Similarly, other main objective is to collect and maintain the authentic database of all the cases for proper monitoring.

The Directorate of Systems was established in the year 1997 as an attached office of the Central Board of Excise & Customs (CBEC) under the Department of Revenue, Ministry of Finance, Government of India. This Directorate was upgraded to the Directorate General of Systems in December 2002. The headquarters of this Directorate are situated at Hotel Samrat, 4th and 5th Floors, Chanakyapuri, New Delhi – 110021.

This Directorate is headed by Director General (Systems & Data Management) assisted by three Additional Director Genrals at the headquarters. (Southern Zone), headed by a Joint Director.

The DG (Systems & Data Management) has been entrusted with the implementation of the projects related to Information & Communication Technology. It has initiated a number of projects aimed at harnessing Information & Communication Technology (ICT) in achieving the objectives of Customs and Central Excise administration. These projects are of far reaching consequence and will alter in a fundamental way, the manner in which the department delivers its services. The duties and responsibilities of the Directorate the enumerated below:

Directorate of Systems

(a)     is responsible for the design, development, programming, testing, implementation and maintenance of Customs and Central Excise automated systems, and for overseeing and managing the projects sanctioned by CBEC related to IT.

The main functions of Directorate of Data Management is to collect and analyze statistics relating to Central Excise & Customs and to render technical advice to the Central Board of Excise & Customs from statistical standpoint. Apart form providing  statistical input to Central Board of Excise & Customs, the Directorate is also entrusted with the job of brining out the important publications viz. (I) Central Excise formations at a Glance, (II) Central Excise-An Abstract of Statistics, (IV) Customs At a Glance and (V) Customs Formations at a Glaance. Besides providing information for mointoring of revenue collection by various Central Excise & Customs Commissionerates, information collected and complied by this Directorate helps Ministry of Finance in framing fiscal policy and taking necessary corrective steps for augmenting revenue collection through the instrument of Union Budget each year and through several Notifications issued from time to time as an ongoing exercise.

(ii)       Powers and Duties of its officers and employees:

            The officers working in the DGS&DM enjoy all the powers vested upon them by the Customs & Central Excise laws. However, this Directorate being an attached office of the CBEC, the powers for implementing Government policies as well as laws relating to Customs, Central Excise & Service Tax are not exercised, as this work is assigned to the field formations and anti-smuggling/anti-evasion units under CBEC. Instructions, Circulars and Public Notices to this end are isssued by CBEC and field formations based on the recommendations of this Directorate. The DGS&DM is also responsible for dissemination of information relating to Customs, Central Excise and Service Tax Laws, CBEC rules, regulations and procedure, travel related information and jurisdicational field offices through electronic media. To this end, it maintains CBEC’s corporate website http://www.cbec.gov.in which contains all the above information updated on a regular basis. This web site also hosts downloadable forms, FAQs and search facility. In addition, for the benefit of its clients using the e-commerce infrastructure there is the gateway ‘ICEGATE’ for filing electronic documents and checking document status etc, and there is an e-commerce website
http://www.cbec.gov.in which disseminates information related to electronic  message formats, procedures to be followed for electronic interchange, code directories used in e-commerce transactions, helpdesk and online chat facilities and facility for filing electronic documents on a 24 × 7 basis. These websites also provide the software for preparing electronic documents in a freely downloadable format. Electronic filing of Central Excise & Service Tax returns has been enabled through the http://www.cbec.gov.in web site.

            CBEC has also been licensed by the Controller of Certifying Authorities to act as a digital certifying authority under the provisions of the Information Technology Act, 2000 to issue digital certificates of Class 3 (providing for the highest assurance on the subscriber’s identify). This facility called iCert has also been set up and operated by DGS&DM and maintains a repository of all  subscribers to whom certificates have been issued.             The Directorate of Data Management collects, analyses and submits statistical information relating to Customs & Central Excise for MIS and brings out certain publications of the CBEC.

The Directorate of Valuation (DOV) was established in the year 1997 as an attached office of the Central Boarde of Excise and Customs under the Department of Revenue, Ministry of Finance, Government of India. The Directorate was upgraded to Directorate General of Valuation (DGOV) in December 2002. The headqurter of the Directorate is situated at New Custom House, Annexe Bldg, Ballard estate, Mumbai. The Directorate is headed by the Director General assisted by the Commissioner and three Additional/Joint Commissioners at the Headquarters office. There are two zonal units functioning at Delhi (Northern Zone) and Chennai (Southern zone) each headed by a Joint Commissioner. Rules on Customs and Central Excise Valuation are notified by the Government from time to time. Instructions and Circulars on Valuation policies are issued by the Central Board of Excise and Customs. Some of these are based on recommendations of the DGOV. The DGOV compiles data and information on prevalent prices of various dutiable commodities in national as well as international markets and disseminates to field formations. The Directorate also maintains various databases such as National Import Data Base, Export Commodity Data Base and Special Valuation Data Base which are used by the departmental officers in the field formations in their day to day work. The Directorate also issues Valuation Alerts on the basis of its studies for the guidance of field formations.

(a)

A National Import Data Base (NIDB) comprising details of imported goods duly analysed by a software to workout certain valuation related parameters. The NIDB is made available to the Customs Stations across the country for reference by departmental officers as a valuation tool in the assessment of imported goods.

Central Registry Data Base (CRD) comprising cases decided by Customs Stations (Special Valuation Branches) in the valuation of goods imported from related parties.

(c)

Export Commodity Data Base (ECDB) comprising details of commodities exported duly analysed by a software for export values and used by field officers as a tool in export valuation work.

(d)

Valuation Bulletins published every month and distributed to departmental officers. It mainly contains news items on commodity price movements and international price details.

Directorate General of Audit has its Headquarter located in Delhi, headed by Director General (Audit) with seven zonal units headed by Addl. Director Generals under its ambit. The primary function of this Directorate is to monitor audit of units paying Central Excise and Service Tax in the jurisdiction of variuos Central Excise and Service Tax Commissionerates all over India. The preformance of Central Excise and Service Tax Commissionerates is ranked on the basis of their annual performance by conducting quality assurance review.

(ii)       Powers & duties of the officers and employees:

            The duties of the officers working in the Driectorate of Audit involves monitoring Central Excise and Service Tax (Audit) and also to grade the Central Excise and
Service Tax Commissionerates on the basis of their performance and quality of audit undertaken.

           The work done by the Directorate is more of a team work due to spartan staff being posted in the Headquarter and the Zones. Because of the flat organizational structure, there is full supervision and control over the work being done.

           In general the norms under which the Department functions are specified in the Citizens Charter and Missions Statement. The norms for evaluating the quality of audit work being done and the performance of respective Commissionerates is based on the following 6 parameters percentage of units audited to scheduled, percentage of detection made vis-a-vis all India detection, detection per audit, percentage of recovery vis a vis all India recover, recovery per audit and percentage of recovery to detection. These norms are being used for ranking of the Central Excise and Service Tax Commissionerates on all India basis.

           The provision of Central Excise Act and Central Excise Manual and Service Tax Act are the primary Rules and Regulations for discharge of audit responsibilities.

Sections,4. (1) (b) (i) The particulars of its organization, functions and duties:

The Directorate of Logistics was set up vide Ministry's letter F.No. A-11019/40/79-Ad-IV dated 23.6.1979 by re-organization of the Directorate of Anti-smuggling, Directorate of Communication and Directorate of Marine to co-ordinate all the activities related to anit-smuggling(Logistics) under the Central Board of Excise and Customs. This
Directorate has its headquarters at New Delhi and is under the supervisory control of a Commissioner rank officer. This Directorate has three divisions as under :-

A   Anti-smuggling Division

B.    Communication Division

C.    Marine Division

The function of these three Divisions of this Directorate have been enumerated in the said circular and are summarized as under :-

(A) ANTI-SMUGGLING DIVISION
 

(a)

Assessment of the needs of Anti-Smuggling Equipment (including arm & ammunitions) of field formation, formulation of proposals for their purchase, obtaining of sanctions from the Ministry and acquisition, installation/distribution of the same.

(b)

Monitoring of the stocks of seized, confiscated and ripe for disposal goods with the Commissionerates.

(c)

Inspection and stocks taking of the anti-smuggling equipment and stocks of seized, confiscated and ripe for disposal goods in the anti-smuggling wings of the Commissionerates/Custom Houses.

(e)

Maintenance of statistical data bank relating to Investigations, Adjudications, Rewards, Prosecutions stocks and disposal of goods and prepration of monthly Performance Indicators bulletin.

(f)

Loaning of seized/confiscated arms to departmental officers.

(g)

Acquisition and deployment of Sniffer dogs.

(B) COMMUNICATION DIVISION
 

(a)

To plan and formula to wireless communication proposals for Customs Preventive Commissionerates and obtaining sanctions from the Ministry for acquisition of wireless equipment.

(b)

Distribution of wireless equipments amongst the Commissionerates and monitoring wireless traffic passed over the wireless networks.

(c)

Providing support for the maintenance and repair of wireless equipments in the Commissionerates and Inspection thereof, and training of telecommunication staff.

(d)

Coordination with regional command Security Committees under Ministry of Defence in the matters relating to breaches of communication security.

(C) MARINE DIVISION
 

(a)

 Examining proposals for appropriation/condemnation of vessels received from maritime Commissionerates and extending technical support.

(b)

Procurement and supply of technical and general sea stores through Central Stores Yard, Mumbai.

(c)

Overall supervision and control over the four workshops for repair of the vessels.

(d)

Maintaining statistical data pertaining to crafts and crew.

(e)

Recruitment of trained and disciplined technical personnel for operating vessels, workshops and Central Stores Yard.

Apart from the above said functions pertaining to Anti-smuggling Communication and Marine Division, this Directorate has been entrusted with the work of maintenance of Customs & Central Excise Welfare Fund, Performance Award Fund and Special Equipement Fund. With a view to providing financial assistance for various schemes for the promotion to staff welfare and for acquisition of Anti-smuggling equipments of specified nature within the shortest possible time and for the purpose of providing assistance for the welfare of community at large including removal of difficulites caused by natural calamities like Floods, Earthquake, Droughts etc..

(ii)       The powers and duties of officers and employees :

The powers of the officer are as available under Circular No. F.No. 11019/40/79-Ad-IV dated 23rd June 1979, Govt. of India, Ministry of Finance, Department of Revenue. With respect to the duties, the various functions as enumerated at Sl. No. (1) above are required to be carried out by the officers of this Directorate in cordination with CBEC, Directorate of Revenue Intelligence, Directorate of Systems, All Chief Commissioners and Commissioners of Customs and the Regional Units of this Directorate.

(iii)      The procedure followed in the decision making process :

                The procedure followed in the decision making process wingwise as per hierarchy of the organisation is as under:-

 (i)   Anti-smuggling Division: Commissioner—Additional Commissioner—Joint Commissioner—Assistant        Commissioner—Superintendent.

(ii)   Communication Division: Commissioner—Joint Director—Deputy Director—Assistant Director—Superintendent—

With regard to the Administrative matters - proposals are processed at the section level and put up to the Assistant Commissioner- Additional/Joint Commissioenr and finally approved by the Commissioner.

With regard to the anti-smuggling proposal are processed at the Superintendent level and put up to Assistant Commissioner/ Joint Commissioner/ Additional Commissioner/ Commissioner and then through DG(DRI) submitted to the CBEC (where so ever required) finally approval by the Commissioner.

(iv)      The norms set by it for the discharge of its functions :

The Directorate of Logistics is a nodal agency to monitor the work of Anti-smuggling Division, Communication Division, Marine Division and maintenance of Customs & Central Excise Welfare Fund, Performance Award Fund and Special Equipment Fund. Accordingly, the Directorate of Logistics is required to work in close co-ordination with the Central Board of Excise & Customs, all Chief Commissioner of Customs (preventive) and Chief Commissioner and Commissioner of Customs including DGDRI.

The Directorate is assessing the requirement of the field formations for anti-smuggling, Communication and Marine (Logistics) from time to time and then processing it to take follow up action accordingly.

This Directorate is also processing all the applications received from the officers in various field formations of CBEC for financial assistance from Welfare Fund and Performance Award Fund on day to day basis. This Directorate has also been entrusted with the work relating to the compilation of statistical information regarding receipt and disposal of seized, confiscated goods and preparation of Monthly Bulletin and other returns/reports for field formations. This Directorate is also required to carry out inspections in the different field formations under CBEC.

In view of the nature of work undertaken by the Directorate of Logistic the norms are fixed in such a way to process the requirements of the field formations for Anti-smuggling (Logistics) in time and also to process all the applications received for financial assistance from Welfare Fund, Performance Award Fund and Special Equipment Fund on day to day basis.

(v)        The rules, regulations, instructions, manuals and records, held by it or under its control or used by the employees for discharging its functions.

Functions:

(ii)       To study the staff requirement at field level for proper and effective implementation of service tax.

Section,4(1)(b)(i) Particulars of the Organisation its functions and duties

The organistion

The Directorate General of Vigilance, Customs and Central Excise is the apex body under the Central Board of  Excise and Customs for the vigilance matters. The Directorate General interfaces with the Central Vigilance Commission, the Central Bureau of Investigation, field formations of CBEC who are also having their Vigilance wings and others in all the matters relating to Vigilance, preliminary investigation of complaints, obtaining CVC/CVO’s first stage advice, wherever required, assistance to Ministry in issuance of charge sheets, monitoring the charge sheet issued by the Disciplinary authorities in the field, monitoring of progress in inquiry proceedings, processing of enquiry reports, obtaining CVC/CVO’s second stage advice, wherever required and communication thereof to Disciplinary authorities and monitoring compliance/implementation of the advice.

The Dirctorate General of Vigilance has its headquraters at New Delhi and has four Zonal Units-North Zonal Unit at New Delhi, West Zonal Unit at Mumbai, East Zonal Unit at Kolkatta and South Zonal Unit at Chennai. The Directorate General is headed by the Director General and the Zonal Units are headed by Additional Director General.

Functions and duties of the Directorate General

The functions and duties of the Zonal Units of the Directorate General are mainly as follows:

(i)        To co-ordinate the work of various vigilance formations in Customs. Excise and Service Tax Commissionerates.

(ii)       Liaison with CBI.

(iii)     To investigate vigilance complaints received from the public and complaints forwarded by Headquraters, by the CVC and other Vigilance Organistions.

(iv)      To carry out various preventive vigilance studies for improving the functions of the field formations of Customs, Excise & Service Tax Commissionerates.

(v)       To carry out preventive checks at sensitive locations to control corruption in Excise, Customs & Service Tax Commissionerates.

(vi)      To carry out inspection of Vigilance Section of the Commissionerates of Excise, Customs & Service Tax.

The functions and duties of the Headquarters of the Directorate General are mainly as follows:

(i)      To get the various complaints received from public or through CVC and other formations investigated through the Zonal Units or field formations.

(ii)      Processing of Investigation Reports received from the Zonal Units of the Directorate General; field formations of CBEC or CBI for obtaining CVC/CVO’s first stage advice for further action where Gazetted officers under the  CBEC are involved.

(iii)     Liaison with CBEC, CBI, CVC in disciplinary matters.

(iv)      Compliance with the directions of CVC in disciplinary matters.

(v)       To assist the Disciplinary Authority in disciplinary and prosecution matters relating to Group ‘A’ officers under CBEC in consultation with CVC.

(vi)      To monitor and supervise issuance of Charge Sheets to the officers, conduct of  Inquiries and to process the Inquiry Officer’s report for obtaining CVC/CVO’s second stage advice.

(vii)    Advising Ministry on matters of Vigilance Clearance in respect of Group ‘A’ officers under CBEC.

Procedure followed in Zonal Units

The main function of the Zonal Units is to investigate the complaints received from Public or through Hqrs. office/CVC & other vigilance formations. The complaints are marked to Superintendent or the Assistant/Deputy Commissioner for investigation and the investigation reports submitted by them are examined at the level of Joint/Additional Commissioner and thereafter by the Additional Director General and then submitted to Hqrs. Office with suitable recommendations.

Procedure followed in Headquarters/Channels of Accountability:

The Preliminary Investigation Reports in respect of various complaints received from the Zonal units, field formations or CBI and the Inquiry Officers Reports are first examined at the level of Superintendent or Assistant/Deputy Commissioner, then put up to the Joint/Additional Commissioner and Additional Director General (Hqrs.) and thereafter to the Director General for obtaining CVC/CVO’s first or second stage advice. If Group “A” officer is involved the matter is generally referred to CBEC for concurrence before obtaining CVC advice. The Headquarters is headed by a Director General who is an officer of the rank of a Chief Commissioner and he is assisted by an Addl. Director General under whom work the Jt. Commissioners who are assisted by the Deputy/Asstt. Commissioners and Superintendents and in general all the matters are examined/processed through this hierarchy.

(iv)      The Norms set by it for the discharge of its functions

The Citizen’s Charter issued by the CBEC provides that the complaints will be promptly acknowledged and final replies will be provided within 30 working days of their receipt. Any complaint or grievance can also be taken up with the Public Grievance Committee headed by the Commissioner and/or the Zonal Grievance Committee headed by the Chief Commissoner.

(v)        The rules, regulations, instructions, manuals and records held by it or under its control or used by its employees for discharging the functions.

The Vigilance Manual of the Central Vigilance Commission (CVC), the CCS (Conduct) Rules, 1964, the CCS (Classification, Control and Appeal) Rules 1965, CCS (Pension) Rules, 1972 and the various instructions issued by the Government of India and the CVC relating to Vigilance matters are the rules/ manuals used by the Directorate General of Vigilance for discharging its functions.

NATIONAL ACADEMY OF CUSTOMS, EXCISE & NARCOTICS
NACEN COMPLEX, SECTOR-29, FARIDABAD-121008


Section,4(1)(b)(i) Particulars of Organization, Functions and Duties.

The National Academy of Customs Excise & Narcotics at Faridabad is the apex training institute for the Central Excise, Customs and Narcotics Department of India. It started as a training school from a small building at Daryaganj. Old Delhi in 1969 and then shifted to Hauz Khas in South Delhi. Later, it operated from the premises of Pushpa Bhavan till 1996 and has been functional at the present 23-acre lush green complex at Faridabad. Since then  a recent addition has been the new administrative block that is equipped with 5 lecture halls having state of the art audio-visual equipments and teaching aids. The new block also has a well equipped fully computerized library, a large auditorium, conference rooms, e-learning center, computer lab and an amphitheatre. The Academy has a Center of Excellence headed by an Additional Director General to undertake research in areas relating to indirect taxes. Besides the Academy have three hostels and a VIP guesthouse. The rooms are equipped with all the modern amenities. The Academy also has excellent sport facilities that include a swimming pool, gymnasium, billiards room, squash courts basketball. lawn tennis and other outdoor games. The Director General is overall in charge of all the training functions in the department. There are 9 Regional Training Centers at Delhi, Mumbai, Kolkatta. Chennai, Bangalore, Hyderabad, Vadodra, Hazaribagh and Kanpur that cater to the training of the Group B and Group C officers. NACEN, Faridabad is basically responsible for the training of the Group A probationers of the IC & CES. In cadre training & training on specialized topics like Service Tax, VAT. Valuation, Audit, Enforcement for the group A officers. These courses on specialized topics are need based and oriented towards capacity building of the officers of the Department.

NACEN has also taken over the training in many of the new areas Notable amongst them is the pioneering effort in the field of environmental crimes. NACEN has entered an MOU with UNEP to train the Customs officers in India and the Asia-Pacific region on the smuggling of Ozone Depleting Substances. NACEN has been conducting such workshops all over the country and abroad for the last three years. This has shown results in the field with increase in the number of seizures of these substances all over the country.

NACEN has also been recognized as the Regional Center of the World Customs Organization. With this NACEN will start training Customs officers of the Asia-Pacific Region under the aegis of the WCO. NACEN is also actively involved in the development of synergy on various capacity building issues with the US Customs. Asian Development Bank, Customs Organizations of SAARC countries etc.

At NACEN the main emphasis on training is to improve the knowledge base. Provide managerial skills and develop positive attitude of the officers of the Department. This emphasis is reflected in the training of the Group A probationers that is spread over 18 months and includes not only classroom sessions on various topics but field visits. attachment to field formation and on the job training. The probationers are given inputs on Customs, Central Excise, Narcotics, law, audit, administration, accountancy and various other fields. They also interact with important personalities in various fields. NACEN is committed to provide quality-training programmes that ensure capacity building in the Department and contribute towards providing a modern effective tax administration.

(ii)       Powers and duties of its Officers and Employees

Apart from the normal administrative and establishment functions and duties carried out in Central Government Offices, this Academy’s main function is to impart training to the Officers/staff of Central Board of Excise and Customs and other agencies on Customs, Central Excise, Service Tax and Narcotics laws and other related issues. In addition, this Academy also have a Centre of Excellence for doing research work in the field of Indirect Taxation. Training Calendar for NACEN Hdqrs. as well as its RTIs are prepared in the beginning of each financial year containing schedule of various courses planned to be conducted during the year. These courses are conducted with the help of in-house as well as out-sourced faculty. Eminent personalities who are experts in their respective fields are called for delivering lecture to the participants. The Academy also prepares material which includes law and latest instructions on various subjects for use by the participants.

(iii)      The procedure followed in the decision making process, including channels of supervision and accountability

Training modules are designed as per need and requirements of field formations under CBEC. In keeping with the changing work environment of Customs and Central Excise Officers, This Academy has conducted several courses on improving basic computer knowledge of the officers and staff and almost 100% Computer literacy has been achieved at Group A, B and C levels of officers in CBEC. NACEN Hdqrs. and its RTIs have also been conducting courses on Accountancy and Scrutiny of Financial Records by the Central Excise Officers in EA-2000. Faculty for delivering lectures is selected very carefully after ascertaining their field experience and competence. There is a system of feedback from the participants at the end of each module on the relevance of the subject and to assess the faculty. This feedback is always considered and taken into account while designing the new modules on the subject and selection of faculty. Decision on selection of faculty is taken at DG level.

An officer in the grade of Additional/Joint Director is designated as Course Director for each course conducted by NACEN and RTIs. Officers in the rank of Assistant Director/Deputy Director. Superintendent and Inspector assist the Course Director in organising the course. The courses are conducted under the overall supervision of Director General.

(iv)      Norms set by it for the discharge of its functions

Norms are specified in Citizen’s Charter and Mission Statement. Depending upon the requirements of the field formations, norms are set for conducting maximum number of courses in a year at NACEN Hdqrs. and its RTIs and accordingly. Training Calendars are finalized.
